Apple wins court battle over their iPods causing hearing loss
All there is to say is that's just funny that someone brought Apple to court over it. It's like going on a trip to the mountains and suing your travel agent because you got cold.
If you get hearing loss from an mp3 player and the volume was able to be turned down further than it was, it's your own fault that you blew out your ear drums.

I would definitely say that lawsuit backfired.
"The plaintiffs do not allege the iPods failed to do anything they were designed to do nor do they allege that they, or any others, have suffered or are substantially certain to suffer inevitable hearing loss or other injury from iPod use," Senior Judge David Thompson wrote.
That's not even making a case, that's just suing over the possibility of something bad happening.
